Barely given assignments, worried about getting in trouble even though my current boss knows.

I was hired through a temp company to support a project. I was supposed to only work for about 3 months, but the lady I worked for on the project decided to keep me on as an assistant. I was not given a length of time for the extension of my employment. I've now been with them over a year, still working through the temp agency. I still get paid through the temp agency. This job is entirely work from home and I use a company given laptop.

In the beginning, my boss (we'll call her Terry) had a fair amount of projects for me, everything from making spreadsheets, printing labels, all kinds of basic level projects that I could do with my skills (I had no formal training that applied to what the company does, which is marketing). I was basically just doing busy work/assistant/support type things.

As months went by, I was sent less and less projects to do. I would email Terry and another manager asking for things to do, but getting a response was hit-or-miss. I would just sit at my desk and read a book or play on my phone waiting for a response. (I never used the company equipment for non-work related things.)

At one point, she cut my hours because she had nothing to send me, then raised them again when there was a project to do again. After that, my hours were never cut again. Yet I was not communicated about my role, so I went back to assuming I was in a 'sit in front of your computer and wait for an assignment' role. This continued on for a long time. Many times an entire week would go by where all I did was sit in on 2-3 company meetings a week that had nothing to even do with me.

About two months ago, the team I was part of started falling apart, and Terry was moved to another team, and I was given a new boss (call her Erica.) My new boss is very aware that Terry rarely gave me work to do, and I've made it clear to her that most days I have nothing to do, and that in the entire year I'd been there at that point, I've never been trained, never been hired formally, nothing. I'm still a temp after a year+ because Terry never did anything to get me hired properly with the company or give me a real role and training.

Erica was shocked they still hadn't hired me properly. She's been trying to vouch for me and get them to hire me properly as a member on the team and take over her old role. She told me for now to just 'enjoy the free time' and to 'hang tight' because she's trying to get them to actually hire me. But for now, she doesn't have time to give me many assignments in the meantime because she's overworked after the team fell apart and she is now doing the role of several people. She's just too busy to stop and instruct me on how to do tasks for her.

While I appreciate her trying to get me hired as a proper company employee and she told me she didn't say anything about how I often lack work to do, I am still worried about their HR looking into me and finding out about how little work I've been given to do. I'm concerned they will see no place for me and let me go, or even ask for pay back.

But given my situation (being a temp and not directly working for them) can they do this? Can I get sued for back pay for the days I was given no work, because both of my bosses are aware and never told me otherwise? I can understand if I still logged my 40 hours a week and was told "you're only paid for the assignments we give you" but I was never told that. In fact, I was given next-to-no communication about my role at all. I still always sat in front of my laptop every day from 8:30 to 5. I never just punched in and then went out. I was always available any time someone did reach out to me.

I want to believe I'm safe and won't get in any legal trouble, but is there anything I should do? I'm scared if I speak up, they'll deem me 'unneeded' and let me go anyway and I can't afford to lose my job right now. Please help.
