To emplyoers and HR administrator (about background check)

Do employers usually reject their applicants if they see a misdemeanor on their records as they run a background check, such as dui?

I am currently actively looking for a new job (software engineering jobs) and I have a misdemeanor record on my background for driving under the influence (got a court hearing date for expungement next month).

Also, when should I let the interviewer/recruiter/employer know that I have something on my records during the hiring process?
