Complicated work/transition situation.

A little background.

Our company was licensed out, in March we were told we would be made redundant at the end of 2018. We were also told the new company would probably re-hire us.

After nearly 6 months of being in limbo (and applying for other jobs) we were informed that we were being picked up, and that letters of offer would be made and contracts to follow.

Letter of offer was made, salary was way below current rate. It was a mistake on the part of the current company giving the wrong salary info to new company.

I applied for one last job I had been recommended for, went through two interviews and then there was a lengthy wait. In the meantime the revised letters of offers came back with a improved salary ($5k more than current salary) and ultimately was told to sign it or the offer would be withdrawn. After signing a week later I found out I didn't get the job.

FFWD two months and I get flown from NZ to Melbourne for a two day training session/conference, new HQ is nice but nobody seems to give a care that we are 6 weeks out from the transition between the two companies and more or less nothing major has happened with the transition of the businesses.

Also while there I am handed my official redundancy letter, stating that I am redundant as of Dec 31.

I still don't have a contract with the new company that is hiring us, all that I have is a signed letter of offer and the knowledge that they have spent money flying me to Melbourne.

Here's where it gets interesting...

While I am there I get a text from the person who recommended me to the previous job with two interviews, "we would like to call you there's a job here that is earmarked for you"

I scheduled a call for the following day (yesterday), sure enough the original role I had applied for (that got shuffled around into a new role) had come up again, and they wanted to get my verbal references so they could do the last checks on me with current and previous employers.

I had to inform my general manager that he was to expect a call and he was understanding of the situation, basically said something along the lines of "this will teach them to not muck around with not getting contracts and leaving things to the last minute".

I directly report to the operations manager who is also my brother. It's a small company and we've all been through the wringer over the course of this year with the news, non communications etc. We had sat down and signed on to the letters of offer together, I had stated that I would give this 6 months and see how the new company goes. However I did state that I wouldn't apply for any jobs but that if something came up I would have to consider it.

Brother did not take the news well, basically said that I've screwed everyone by potentially leaving the company now. Everyone is is going to be really screwed over by this as I am a key part of the transition. Also threw in that the new company could potentially seek recourse against me for the funds spent on me for my trip.

How do I mitigate this? Ultimately I want to ensure that my relationship with my brother survives this (it will, it just needs some time) fairly intact. Does the new company have any grounds to seek $$ off me? Am I an asshole for doing this?

I have two friends who work in this industry and they have told me that no-body gets a shot like I have, this for me is a career defining moment and it has come my way TWICE. As much as it hurts that I have reneged on a signed letter of offer, and that I will be letting colleagues of the last 6 years down I feel like this is 100% the right decision for me and my family.
