Do I need to tell that I just resigned (in my notice period now) from my current job in an interview

2.5 months ago I started my current job and honestly even from the first month or so I have started to feel terrible about it. It is definetly not a good fit and soul sucking environment. So i have started to send out applications afterwards just to escape. Initially some rejections, some ghosting.. all is as expected. In the mean time the current job kept on sucking more and more, so last week I decided to put in my resignation, because it started to affect my mental health. As of today I started the notice period of 1 month which is mandatory by law where I live. So on jan 1st, i will be done with this place. I am financially good for several months and I wanna go back to my old industry, so my initial plan was to look around and keep applying.

Here is the thing, one company that I have applied before quitting contacted me. Recruiter called and told today that they are impressed and want to schedule an interview soon with the line manager. Well my resume includes my current soul sucking job, I didnt remove it, so this new place thinks I am still actively working there. Recruiter even asked me what is my notice period if I want to leave my current role... I acted like I didnt resign at all, just told him 1 month.

Now I am worried because I dont know how to tell them that I quit and already in my notice period. I think if things go promising I have to tell them because security and job background check is a common thing in my country. Also this new place probably knows that by law everyone should give 1 month notice.

So reddit, how can I talk about my situation in a very short and convincing way, without diminishing my value or prospective job offer salary? Obviously I am not gonna say it sucked here, I will use all these career path change bla bla better fit etc... It is just that at some point they should know I already quitted and my notice ends in January.
