I just found out with the help of r/legaladvice that my job/compensation is in violation of FLSA act ruling re: exempt employee. I make 30k/year, well less than the $684/week baseline for an exempt employee. I am not paid overtime but frequently work in excess of 45 hours/week, and often more than 50 within 7 consecutive days (rather than a “traditional work week” that starts Sunday, as I work weekends). Furthermore, my day to day duties don’t really parallel what an exempt employee should do in my field.
I’m terrible at confrontation and have always cried when I’m stressed or upset. Worse, I’m the only woman who’s made it this far up in the ranks at this place which is in a very male-dominated field.
I’m very upset about this but would ultimately like to maintain a good relationship with this place, even if I don’t want to work for a company that screwed me over for much longer. I don’t know that my manager himself knows that I’ve been underpaid, but he may. We have a good relationship, but I recently took off time and inconvenienced him, so I’m not sure how receptive he’ll be to complaint. For context, I am his direct assistant.
