So I resigned. Then I got a paycheck at the end of the pay period when I resigned. I expected that, although my questions begin here.
Then I got a paycheck two weeks later. Okay. The company policy is to pay out accrued vacation time, which I happen to have three weeks of, so I figured this was that.
Two more weeks, and another paycheck is deposited. This time I figured out how to log in to the payroll system, and I look at it carefully. It's a regular paycheck. It says I'm an active employee. They are taking out benefits and other normal post-tax deductions. Money is going into the 401(k).
So it dawns on me -- They still haven't terminated me.
Now on one hand, I'm entitled to pretty much exactly what I've received thus far, maybe slightly more. But on the other hand, this paycheck goes well beyond that. And I know I will have to pay that money back, if they don't claw it back. And that doesn't bother me.
What bothers me is that I might have to pay back everything they deposited all the way back to my termination date (and I've already spent most of that) even though they still owe me for that whole PTO severance, which, according to the written policy, is the policy but is "at the company's sole discretion."
So at this moment I don't know if I'm "zero sum, it's an annoyance and a wash" fucked, or if it's "I'm gonna end up owing my former employer a paycheck and a half even though I have three weeks of vacation pay coming to me" fucked.
HR gurus of Reddit, which way am I fucked here?
