So I’ve been working for Company A for three years now. It is a food service management company and I work in the K-12 school food service division as a director.
When I was hired, I was coming from managing the food service program at a private school where I was making peanuts (15k with no benefits). I just had my second child and need a better salary and benefits.
Company A offered me over double my salary with benefits. When they hired me as a trainee, I was told I needed to sign a non-compete covenant or I wouldn’t be hired. I was desperate for the pay and signed it.
After working as a trainee for 4 months, I was assigned an account about an hour and half away as a director. This account had a lot of problems that I was ill-equipped for. In 5 years they had been through 5 different directors. It has been a tumultuous time at this account, though I have a great relationship with the school district administration.
This year was particularly difficult. At one point I called my boss and begged to be moved to a different account because of the toxic environment and I was told no because I get along so well with administration.
The past month I have decided to apply for other jobs. I’ve cast a wide net, applying for all sorts of jobs in several different industries and several different states (currently in PA).
Enter Company B. I found a posting for a director position with another food service management company that pays 10% more with 2 months off during the summer at a district only 25 minutes from home. I applied and received a phone call from Company B asking to interview me.
This company is well aware of my company’s non-compete clause. He mentioned it first thing and told me he had previously interviewed other people from my company who got cold feet and backed out.
After speaking with him, I got a phone call later that day from my current boss. She was very hostile on the phone and told me if I interviewed with Company B I would be in violation of my contract and they would pursue legal action. I was floored. I cried on the phone and explained I’m just trying to find the right situation for my family. She offered to come to my office to help me with work.
I then emailed her that evening and told her I was taking a couple PTO days for mental health reasons. I’m feeling really kind of violated I guess?
At any rate, I had our lawyer quickly look over the contract to see if there was anything forbidding me from interviewing and was told no. So I interviewed with Company B today.
This company doesn’t use non-competes and the person interviewing me seem genuinely shocked that my current employer found out we talked and threatened me.
So basically I feel like I should leave Company A now. I was already miserable there and I feel like our relationship is irrevocably damaged even if I don’t get offered this other job.
Thoughts? What would you do?
