Hey Jobs, I'm wondering if you guys can provide resources/advice for me. I've worked for a very small renovation company for years as a W2 and since Covid has started my employer has received two different PPP loans. For the first one during the loan period there were hours that he paid me for that he then made me repay after the loan period, and that amounted to two weeks of pay that I worked for free, (this work is pretty physically taxing and he also gave me no indication that I had to pay it all back at once, which made me pretty upset.)
For the Second period, I made sure to say, hey!, I need to be guaranteed 40 hours/week before the PPP loan so that doesn't happen again. Nevertheless, this past two weeks he hasn't provided me 40 hours a week even though I've asked to come in on weekends and make up hours... but yet his accountant (girlfriend) is still saying I owe hours back after the period is over.
Is this legal? What are my options? My thoughts after researching into this is that the PPP loans are intended to provide beleaguered companies with a way to pay employees, and if the employer can't provide the total amount of hours that's not the employee's problem... because the intention of the loans are to give the employees a paycheck so they can survive during Covid. However, I haven't been able to find any case law on this or specific resources. I intend to contact a lawyer on Monday morning, but it's difficult since my employer does not allow me to take breaks during the day so it's hard to get away to make a call like that during regular business hours. I've tried contacting lawyers this weekend but all I'm getting are voicemails.
By the way I'm in central VA if that helps with state law.
Really appreciate any responses since I broached this subject very subtly with my boss, and he said he wanted to discuss it during work on Monday, and I'm pretty nervous about it.
