Company is saying they made an error on my offer letter regarding non-exempt / exempt status and want to take away Unlimited PTO as a benefit. (California)
I've been with the company I'm at since October 1, '18. Fast forward to today.
I was putting in to request time off in Workday because I’m planning a short vacation next month. My boss and I both noticed that it listed my PTO as being accrued when I’m supposed to have Unlimited PTO as was listed on my offer letter and told to me by both my boss and my recruiter during my on-boarding process.
So I brought it up to the HR team on Tuesday, 3/19, and today the 21st, someone came down and wanted to sit with me and explain what had happened. I wasn't about to go in there alone, so I asked my boss to sit in with me. They’re trying to tell me that there was “an error” that was made on my offer letter as offer letters are manually created based on each position; And that my position is supposed to be a non-exempt position. Therefore, I have to accrue PTO and do not actually have unlimited time off, which is what I was told verbally from the beginning of the interview process though 3/19/19, and what’s clearly indicated on my offer letter that I signed.
They told me that they can't just make an exception to my situation as there are other people that have my same title / position, and they were set up the correct way (as non-exempt) so they “have to be fair”. Since my boss sat in with me she brought up and suggested that we change my position title to one that does have the unlimited PTO as a benefit. The HR lady said that it would be something that she'd have to talk to her boss about but she couldn't confirm or deny that as an option.
As of right now there is no resolution because the lady has to talk to her boss on what options we have but this is the second BIG mistake the recruiter that on-boarded me has made and she’s no longer with the company so a lot of this looks one-sided.
The first mistake was that told me that I needed to start BY 10/1/18 in order to be eligible for a merit increase. When review and promotion time rolled around, she was already gone and the folks that replaced her told me "that there was a misunderstanding and I would have to have started by 9/30 in order to be eligible for any merit increase or bonus". But luckily I stood my ground and spoke to enough important people about how there was no miscommunication, that she gave me incorrect information, so they made an exception and made me eligible and they gave me a small minuscule raise but it's still better than nothing.
So I don't know what to do at this point and I don't really have any resources since I'm still pretty new.
In terms of any obligations, does anyone have any suggestions on how to move forward or has anyone been in a similar situation? Unlimited time-off was and is a HUGE benefit that I based a large portion of my decision on me taking this job.
TL;DR: I was told that I have Unlimited Time Off as a benefit and am just now being told that the person who sent me my offer letter fucked up and shouldn't have put that and they are implying that they want to take it away.
