So I work in a job where I have to pass some licensing tests to keep my job in the state of NJ. I have failed them & my employer said I was being let go. They said they are writing a termination letter I have to sign to move on from the company. I have read the termination letter & it seems like they are writing it so that I can sign my rights away to unemployment benefits, also they will keep me ‘hired’ with no pay for 30 days. In the letter they wrote it as voluntary when I didn’t want to be fired. Is this even allowed it just seems so one sided? Here is the letter
Job Search Agreement
The purpose of this letter is to document our conversation on XX/XX/XX. At the time, we discussed that your role requires registration and unfortunately you have not been able to pass the exam (s). You will not be able to remain in your role without registration. At this time, you will be placed in a working 30 day paid job search and a non-working 30 day unpaid job search in lieu of remaining in your current role. Your job search will be from July 8 to August 6. Your unpaid job search will be from August 7 to September 5.
If you have not secured another position within the company by September 6, you hereby agree that your voluntary resignation will be effective September 6. Your employment will be separated accordingly, however, you will be eligible for rehire and can continue to apply for positions with X as an eternal candidate. Should you be rehired within 180 days, your years of service may be bridged in accordance with X’s continuous service policies.
If you should find employment outside of X prior to September 6, the effective date of your resignation will be the earlier date. In the event you obtain employment with X prior to September 6, you under and agree that this agreement will end in the day you start your new position or September 6, whichever is sooner, and that your ongoing salary will be that offered in the new position.
