Possible Employment Verification Issue

So I have a small problem I think. I have been interviewing for a new job and in the middle of the interview cycle I was told I was being laid off. This happened on 03/22 and I was told my last working day would be 03/27. I was given a signing bonus when I joined and in order to get that back my employer decided to withhold my final two paychecks from me. For this reason I am still classified as employed by them and on payroll until 04/09. For this reason I have not told my recruiter or the company I am interviewing with that I have been laid off because it won't be official until 04/09.

Considering this do you think there will be an issue with employment verification if/ when I am offered this new job. In the event they offer me the job early next week which is something I anticipate and I list I am employed will that be considered lying as long as I fill in the employment verification forms before 04/09?

My old employer uses a payroll processing company and it still says I am employed by this employer and the automatically generated employment verification letter says that as well. Also I still have access to my jobs health insurance for this month too. In the event that changes during the employment verification process will that cause any issues and will my explanation of what happened be acceptable?
