My friend works for a company that supllies takeouts. He was provided with a van that had a broken or loose handbrake. He delivered goods to a customer but the van rolled and hit the customers car. The boss therefore made him pay the customer a huge sum of money for repairs.
My question is, should this have gone through insurance? To me it just seems like they made the employee pay just so the premiums of the company don't go up. Also they provided him with a van that wasn't road worthy, the company IMO should have ensured something as important as the handbrake was working.
More context, it's a company that doesn't pay it's employees minimum wage so because of that again to me it seems like he gets away with a lot of things that's illegal, like making employees work overtime and paying them the standard cash in hand etc
