Should I take this salary based job

I have owned my own business for eight years. Business is slow down quite a bit. To add to the problems my sisters boyfriend lost his job. So my sister begged me to hire him. I did for two years and actually he became a good employee. Now my sister and him split up. He went back to his family which is 10 hours away. When I heard him it was quite a burden along with my brother that works for me. My business is in shambles. I was offered a job a little below six figures. But it salary, if I work more than 40 hrs do I get paid overtime? I’m in A specialized business. Do I have to have this in a contract to get paid after 40 hours. The guy says it almost doesn’t happen. So I don’t believe them. I would just like some advice. thank you.
