Took COVID-19 Test, is my boss legally obliged to let me not come to work while I am waiting for the results? Also does quarantine start when the positive status becomes known?
I would greatly appreciate some advice on this.
TLDR: Coworker tested positive for Covid. I was in close contact with the coworker. Was covering the office since the coworker stayed home. Only found out last week about the exposure and was in quarantine since. Is quarantine supposed to start from the day I was notified of my exposure?
Took Covid test. Results will come next week. I have the notice that I took the test and am under their care from the clinic I went to. The notice is signed and has a note that I am not to return to work. Does my boss have the right to ask me to come in to work even with this notice?
- I am the only person who has been covering the office.
- I am quitting the job and gave formal resignation form right before being told that I need to go home, but I verbally let the boss know about quitting the week of my coworker getting sick.
Context
- My coworker tested positive for Covid and I was in close contact. We share one office, there are no walls there either. Since my coworker got sick I am also the only person who is covering that office. Literally. I come in every day and do both my own and a shift as a long term sub. Apparently my boss can't find someone to cover it for them.
- Another thing: I am quitting that job. I already found another job, and gave notice on the day I took the job (the week before) and gave the physical notice right as I was told that I had to quarantine by my boss, I don't know if the resignation form was submitted. The last two weeks were supposed to be for me to finish everything and move on.
I was sent home to quarantine and work from home when the coworker's status was found. HOWEVER, the status of the coworker was found out the week after they went home sick. I have been going to work since the day my coworker went out sick and until my boss was also notified of the situation.
BUT, in the notice i was given, I was told that the quarantine is since the last day of exposure. I HAVE NOT been in quarantine since then. Between the last day of exposure and the day of the notification I was going to work and going elsewhere since I didn't know about my coworker. Is quarantine supposed to start since the notice of the exposure?
My boss wants me to come in to work next week, most definitely before the quarantine as I see it actually started. I tried to ask for some sick leave so that I could stay some more, but I am told that there has to be someone in the office.
I don't want to potentially infect my coworkers or anyone who may come to the office.
- I took my Covid test on Saturday and was told that my results will come within the next week. I was given a notice from the clinic I went to that I am under their care and that I shouldn't return to work until my results are in. Can my boss still ask me to return to work in person? I have sent a notice that I took my test to HR, the boss and the person in charge of Covid response.
