I have worked for my employer 1.25 years. Being 1 woman on a team with 3 men has been difficult, plus my boss is a day drinking alcoholic (temper, mood swings, etc). On Wednesday, he asked that I clean his unlicensed Airbnb for a paying guest. I did it, but told him that I would not be doing it again without charging him a cleaning fee. His Airbnb is not included in the business or my job description. This enraged him.
Thursday, he yelled at me, called me outside and asked me to explain my perspective. I did so, calmly and professionally. Then he said that he didn't want to be around me and told me to leave for the day without pay**. He said that he doesn't see me as a long term employee, and said he was ready to accept my resignation.** I had no intention of quitting before this (I like my job and am good at it), but his words made it clear that he doesn't want me there.
He told me to come in the next day, but he wasn't at the shop. As I was checking the company email, I saw an email from him to our bookkeeper saying that he will suspend my planned raise because I would probably be leaving the company soon.
I have experienced sexual harassment at this job: Catching him watching porn, urinating in the backyard, commenting on my body & sexuality, and using "babe" instead of my name.
During the COVID lockdown, our business (retail) was supposed to be closed for months, but he kept the business open and employees working full time. My coworker got COVID in July, and he stayed open & staffed full time, lying about the situation to OSHA. I know he got the PPP loan as well...
I am planning to resign by email next Saturday. I am gathering evidence and learning about my rights in this situation. I know that I will have to prove that I was forced to resign and provide proof that it was an abusive work environment in order to get unemployment benefits.
What can I do to prepare for this legally?
What is the likelihood that I will qualify for unemployment if it's a forced resignation?
How should I write my resignation letter so it is clear that the employer is at fault?
Should I tell him about the sexual harassment & Covid issues in the resignation letter, or only report that to the state?
