Should I list a degree I don't intend to finish on my CV?

This has been bothering me for a while. To keep it short, I completed two out of five years of a law degree and then had to quit due to health reasons. After recovering after a year, I went into an unrelated field and got my BA there. So, should I list the unfinished law degree or not? My gut tells me to take it off since it makes me look like a flake, or it will come up in the interview and I REALLY don't want to let anyone in on any potential health issues I might have, or have to lie. On the other hand, explaining a three year gap if the interviewer happens to do some finger math would be equally as awkward. So, what do?
