A bit of a weird situation at work arose today, relating to the increased minimum salary for exempt employees. I was informed on 1/9 that I had been made a non-exempt employee (as of 12/31) since the new minimum salary in my state for exempt employees went up to 58k. I have never worked overtime in my time at the organization, so this doesn’t change my day-to-day.
What is odd though is that I never knew I was exempt to begin with - my first title was non-exempt, and after a messy reorganization and two titles later, I thought that had continued to be the case. I have asked my employer to provide me with documentation of the dates I was classified as an exempt employee.
Most importantly, if I had been made exempt at some point in 2018 without my knowledge, I would have been significantly underpaid, since the minimum exempt salary was 50k, significantly higher than my current salary.
Has anyone been in a similar situation? Right now I’m just fact-finding and requesting documentation, rather than accusing my employer of not complying with state regulations.
