If an employer suspects you of drug use and fires you, but you aren't/weren't and you pass the drug tests, can they still tell other potential employers that they suspected you were on drugs? To me that would be a pretty serious accusation that should require some sort of proof... What if you were sleep deprived from working all night for the company and acted off? One one side if not true it would be slanderous. On the other side if they say "I think [name] was on drugs" and believe it then it's kind of also them saying their opinion. Even if passing a test they could still try to argue you were on something the test doesn't test for, like steroids or something. Any thoughts? In the court of law it's innocent until proven guilty, but since this isn't a legal situation, do I need to prove I'm not on substances? I could take tests all day but they could still play the "could have been something else" card.
If it's not obvious this is a situation I'm trying to figure out. Personal experiences, opinions, anything would be helpful.
